Benefits Attorney

Legal Aid of WV is seeking an attorney to represent clients pursuing public benefits that include Social Security disability benefits, SNAP, Medicaid, Aged & Disabled Waivers and other types of government benefit programs. An ideal candidate should have experience practicing administrative law and a demonstrated understanding of both state and federal means-tested benefits. Work will include direct representation of clients in benefits cases, working with non-attorney case handlers, reviewing cases for appeal consideration, representation of clients when appropriate in appeals relating to public benefits, and providing statewide support to all 12 LAWV offices in their benefits work. The attorney will work with clients and LAWV advocates across the state. Travel is required, though overnight travel will be limited.

Intake Paralegal

This unit will work together to create novel approaches to address tenant issues across West Virginia. This attorney position will get the opportunity to practice regularly in magistrate, family, and circuit court. The main areas of practice will include housing, family law, unemployment, custody, benefits, and domestic violence.

Elkins Attorney

Martinsburg Paralegal Position

This paralegal position will be a member of the WV WORKS Legal Support Project, which is designed to help eligible clients overcome legal barriers to achieve self-sufficiency. The Paralegal will provide direct advocacy consistent with professional, grant, and LAWV organizational standards, in matters involving social security and drivers’ license cases. The Paralegal will be a member of local team conducting outreach to local DHHR and community partners. The paralegal will also work closely in supporting a team attorney in other civil legal issues, including expungement, divorce, custody, and housing cases. The unit is guided by a Project Supervisor and works in concert with project staff across the state. The Paralegal will also work with the Martinsburg office to find pro bono legal services for eligible clients.
